Traumatic Brain Injury (TBI) is a term used to describe several types of head injuries and brain damage. The brain is enclosed within the bony protection of the skull and is surrounded by fluid that protects it from impact with the skull. If rapid force is applied to the skull (impact) or rapid deceleration of the head occurs (whiplash), the brain may strike the inside of the skull. This can injure or kill the tissues of the brain. If an object forcefully enters or ruptures the skull, it can obviously cause catastrophic brain damage.

  • Closed Head Injury - the skull is intact with no penetration of the skull. Direct or indirect force to the head can cause this type of injury. This may be caused by rotational and/or deceleration force.

  • Open Head Injury - head injury with penetration of the skull.

  • Diffuse Axonal Injury - diffuse cellular injury to the brain from rapid rotational movement. Often seen in motor vehicle accidents (whiplash) or shaking injuries. Axons are projections of the brain's nerve cells that attach to other nerve cells. The injury occurs when shearing force disrupts or detaches the axons.

Brain injuries arise from three characteristics of the brain-skull anatomy: the rigidity & internal contours of the skull, the incompressibility of brain tissue and the susceptibility of the brain to shearing forces.

The first two characteristics give rise to contusions or hematomas (i.e., bleeding) on the surface of the brain, one of the most common injuries. There are usually two contusion sites in a brain injury. One occurs at the site of the blow to the brain and the other arises where the brain bounces off the skull when it has been moved away from the site of the original blow.

The third characteristic, susceptibility to shearing forces, plays a role primarily in injuries involving rapid, forceful movement of the head. These forces are smallest at the point of rotation of the brain near the lower end of the brain stem. The resulting shearing forces cause different levels in the brain to move relative to one another. This movement produces stretching and tearing of axons (diffuse axonal injury).

TriMark Capital Funding, Inc. provides fast, affordable lawsuit settlement cash advances from $1K up to $100K – often in as little as 48 hours for plaintiffs involved in traumatic brain injury, head injury or spinal cord injury lawsuits. We also offer brain injury lawyer funding.

The financial impact of cases involving either serious traumatic brain injury can be catastrophic. Costs of emergency care, multiple surgeries and post surgical therapies, psychological care, attendant care at home and special accommodations for the home and vehicles can easily exceed $500,000 in the first year alone and can exceed $100,000 per year after that. Actual costs vary but catastrophic, non-fatal injuries involving the spinal cord or brain damage normally result in extremely high medical costs.

As a result, it's not at all uncommon for plaintiffs involved in brain injury, head injury or spinal cord injury lawsuits to find themselves financially overwhelmed and in need of extra money right away to pay bills and other basic living expenses, cover emergency medical travel, keep their vehicles running and so on. A personal injury settlement loan or lawsuit loan can give plaintiffs and their families the money they need to regain control and finally get their lives back on track.

Traumatic brain injury (TBI) most often occurs in auto accidents, many types of falls, ejection from a vehicle at high speeds, roof collapse during a rollover accident, objects falling and striking the person, impacts of a child's head onto a floor or in a vehicle during collision, motorcycle accidents (even with a helmet), from violent explosions and many other situations both industrial and residential.

Injuries involving some type of blow or striking of one's head are among the most common in our society. Some 700,000 people in North America suffer traumatic head injury each year, and about 10-15 % are left permanently disabled. Head injuries can range from relatively minor damage to the scalp and face such as lacerations, abrasions and bruising to more serious consequences involving damage to the brain, brain stem injuries, frontal lobe brain injury, anoxic brain injury and other closed head injury complications.

When the injured individual losses the ability to earn as a result of the disability caused by either a spinal cord injury or traumatic brain injury, the claim and settlement of the cases involve computing the present value of the lost lifetime of earnings, including probably increases in pay that would have reasonably been expected. When the injured victim is young, the lifetime loss of earnings or loss of earning capacity can be in the millions of dollars.

Traumatic brain injury is a serious and debilitating injury. Persons with a severe brain injury often have problems with mental and physical functioning, and may require on-going supervision and assistance, as a result of post concussion syndrome. Even a person who has suffered a head or brain injury, with little or no documented loss of consciousness, may have permanent deficits which make it impossible for them to return to their previous lifestyle and sphere of activities.

At the same time, a pre-settlement lawsuit cash advance can help balance tough negotiations by giving your brain injury lawyer the extra time he needs to negotiate the settlement you really deserve. This is especially true if a deep-pocketed defendant is utilizing delay tactics to try and force a financially strapped plaintiff into accepting a pennies-on-the-dollar settlement offer.

Waiting for the money from a brain injury, spinal cord injury, head injury, cervical injury, cervical spine injury, closed head injury, spinal injury or neck injury lawsuit settlement can take a long time and can put you and your family into a serious cash crunch. And even if you win your TBI case, you could lose financially if the settlement money you get is too late. With a brain injury lawsuit settlement advance from TCF, you can have immediate financial relief.

Brain Injury Lawsuit Loans & Pre-Settlement Funding
The reality is, even if you have a great brain injury lawyer and an excellent case showing strong liability, these types of lawsuits can take a long time to settle. And despite the best efforts of your attorney, even after you win your lawsuit, you may still have to wait a long time to actually receive your cash settlement because TBI settlements are usually in the form of a structured settlement annuity (periodic payments). We can also help you sell structured settlement payments for cash.

And there is zero risk for the plaintiff OR the attorney because if there is no recovery from your lawsuit, there is no obligation to repay.
